Unemployment Compensation

Over the years, we have represented countless employees who have lost their jobs, many of them through no fault of their own. Many of these people may have been the subject of a layoff, while others have been fired for unfair and unjust reasons.

These reasons range from medical reasons to the employer’s failure to adequately warn the employee of the very policies and procedures they are now being accused of violating. While not everyone is entitled to Unemployment Compensation (“UC”) benefits, many of these people are eligible for benefits. Sadly, many such individuals, who otherwise performed quite well at their jobs, do not retain legal counsel in pursuing their claim for UC benefits.

Without legal counsel, the employee is left to the mercy of the system. Many do not realize, until it is too late, that they have certain appeal rights, the right to a formal hearing, etc. They do not realize that there are procedural rules that apply at the hearings, which, depending upon how they are observed or not observed, can make the difference in the outcome of the case. Even as Menges, McLaughlin and Kalasnik has represented employees in their claim for benefits, we have, likewise, represented numerous employers defending against UC claims as well. We see both sides of the equation clearly. For the employers we represent, perhaps more of our advice is directed to coming up with sound employee policies and procedures to prevent such claims, than it is in the actual defense of the claims. It is our goal to minimize employee claims for UC benefits. This benefits the employee and the employers who hire them. Fewer claims means the employer is spending less time defending the UC claims and more time working on areas that contribute to growth and productivity.

For those employers who do face claims, however, we will meet with you and review the facts surrounding the employee's separation from employment, how it occurred, etc., and from there we will work with you to construct your own defense strategy. We will assist you in preparing your witnesses and the documents you will need at any hearing. Also, we will work with you throughout any appeal process. Equally important, we will advise you of the steps your business should take to minimize the same or similar claims in the future.

Wrongful Discharge

Wrongful discharge is a specific legal theory that may or may not apply to a situation involving the termination of an employee from employment. The law of Pennsylvania is clear and specific, in many respects, as to what types of claims constitute wrongful discharge.
