Every 4 to 5 years the support laws of Pennsylvania are carefully reviewed by the Supreme Court of Pennsylvania; such a review occurred in 2009. As a result, extensive changes to Pennsylvania child support, spousal support and alimony pendente lite law are going into effect in May, 2010.
Among other things, the support amounts for multiple children (a support order for more than one child) have been increased fairly substantially. Certain other apparent changes have been confirmed and made permanent such as very limited or no spousal support or alimony pendente lite for very short marriages.
The law in Pennsylvania has always been that any support order in Pennsylvania can be modified upon the request of either party for any change in circumstances. Any change in circumstances includes a revision in the law and, therefore, we will see many Plaintiffs and Defendants each asking for their support order(s) to be reviewed. Keep in mind that upon any such review, the order can go up, go down or remain the same. So requesting such a review should not be done without the advice of a competent family law attorney.
The bottom line is that if you are paying or receiving support in Pennsylvania for child support or spousal support or alimony pendente lite, these changes are almost certainly going to affect you.
